These Terms of Use govern your use of PhaseKit ("the App"). By downloading or using the App, you agree to these Terms and to any applicable Apple App Store terms.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, lawful use on devices you own or control, subject to these Terms and any applicable platform terms.

Free Core App and Optional Purchase

PhaseKit is free to download and use for building and running timer routines. The App may offer an optional one-time in-app purchase called Support Developer. This purchase unlocks cosmetic app color customization and helps support ongoing development.

The Support Developer purchase is not a subscription. It does not remove or limit the core timer features that are available for free.

Previous Paid App Customers

If you bought the paid version of the App before the transition to a free download, the App is designed to unlock supporter color customization through Restore in the App settings using Apple-provided app transaction information. You should not need to pay again for this supporter unlock.

If the unlock does not appear after Restore, contact support.

Purchases, Billing, and Refunds

In-app purchases, billing, purchase history, refunds, and payment method handling are managed by Apple through the App Store. We do not receive or store your payment card details.

Acceptable Use

You agree not to misuse the App. In particular, you agree not to:

Product Scope

PhaseKit is a general-purpose timer and routine app for custom sequences, grouped timers, saved routines, and focused timer playback.

No Warranty

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the extent permitted by applicable law.

We do not warrant that the App will be uninterrupted, error-free, secure, or available at all times, or that it will meet every specific requirement or expectation.

Safety-Critical Use

PhaseKit is not intended for emergency, medical, safety-critical, or mission-critical use. You are responsible for deciding whether the App is appropriate for your intended use.

Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business, or goodwill, arising out of or related to the use of, or inability to use, the App.

Intellectual Property

The App, including its software, design, text, graphics, branding, and related content, is owned by the developer or its licensors and is protected by applicable intellectual property laws. These Terms grant only a limited right to use the App and do not transfer ownership of any intellectual property rights.

Third-Party Links and Services

The support site and privacy materials may include links to third-party websites or services, including Apple resources. We are not responsible for the content, availability, or privacy practices of third-party websites or services, and you access them at your own discretion.

Changes to the App and Terms

We may update, modify, suspend, or discontinue parts of the App at any time. We may also revise these Terms from time to time. The latest version will be posted at this URL, and continued use of the App after an update means you accept the revised Terms.

Governing Law and Venue

To the extent permitted by applicable law, these Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law rules. To the extent permitted by applicable law, disputes arising out of or relating to these Terms or the App shall be resolved in the courts having jurisdiction at the developer's place of business in Germany.
